ASSURED SHORTHOLD TENANCY AGREEMENT

for the letting of a furnished dwelling house on an Assured Shorthold Tenancy under Part 1 of the Housing Act 1988
 

NOTE: THIS AGREEMENT MAY BE USED

  • Where the landlord/lady is NOT resident on the premises, and
  • Where the letting is for MORE THAN 6 MONTHS, and
  • Only where a prior Notice has been served on the tenant(s) in an appropriate form

PAYMENT OF RENT FOR THE PROPERTY

  The sum of £X.00(=X*£60.00)   for every week of letting.

(a) Upon signing the contract £200.00 per person (registered and returnable) damage deposit.
 

(b) I have found that the most convenient way for all is to take the charge for the whole term of the contract and split it into 3 for three equal payments, paid by post-dated cheques given at the signing of the contract along with the deposit.

GENERAL LETTING PROVISIONS

     
  1. The Landlord lets and the Tenants takes the Property for the Term at
    the Rent payable as above.
     
2. This Agreement is intended to create an Assured Shorthold Tenancy  in
    defined in section 20 of the Housing Act 1988 and therefore the as  provisions for the recovery of possession by the Landlord contained section 21 of the Act apply.
   
     
Council 3. In the event of a Council Tax bill being served on the Property during the
Tax   Tenancy or at anytime after the termination of the tenancy, the Tenants shall be responsible for paying such bill. (At the moment students are exempt but you will have to produce the exemption certificate which is provided for each student by the University.)
   
   
   
     
Service of 4(a). Any notice to the Tenants shall be deemed properly served if served by

  4(b). Any notice to the Landlord shall be deemed properly served if served by
    first class pre-paid post or hand-delivered to the address or registered office of the landlord or his agent.
   
     
Meaning of 5. Where the context admits -
"Landlord"    (a). The "Landlord" includes the person for the time being entitled in
reversion & expectant on the tenancy.
       &    
"Tenants"    (b). "The Tenants" includes the persons deriving title under the Tenants.
     

TENANTS' OBLIGATIONS

     
  6. The Tenants will -
Payment of    (a). Pay the rent at the times and in the manner specified. Once the date for
Rent and   collection of rent has been given by the landlord ( which may be later
other   than the date specified on the contract), if the rent is not paid on that date
Charges   and there is no prior or reasonable explanation , there will be a charge of
£10.00 per subsequent visit for collection of outstanding rent.
     
     (b).  Pay for all gas and electric light and power (or proportion of) which shall
    be consumed or supplied on or to them Property during the Tenancy  and 
    the amount of charges made for the use of the telephone (if any) on the
    Property or such proportion of them as agreed by the parties.
     
Damage to   (c). Not damage or injure the Property (or items in the Property Property).
Property   NOTE: BLU-TAC MUST NOT BE USED ANYWHERE   It is very difficult to remove and when removed often rips wallpaper and/ or stains.  Tenants may  be charged for re-painting/ decorating an entire room if this happens.
     
      The tenants are responsible for any damage to each bedrooms' door, doorframe and door furniture and for any damage to doors, doorframes and door furniture in common areas.
     
     
Tenants   (d). Not do or suffer to be done on the Property anything which behaviour
Behaviour   may be or become a nuisance or annoyance to the landlord or occupiers 
    of any adjoining premises (including unreasonable noise) or which may 
    vitiate any insurance of the Property against fire or otherwise increase
    the ordinary premium for such insurance.
     
Cleaning   (e). be jointly responsible to keep all common areas of use in a clean and
    tidy manner. If it becomes apparent that the common areas of the
    property are constantly dirty and untidy, a cleaner will be employed by
    the Landlord at the expense of the Tenants to rectify the matter. The
    outside and inside of the windows are to be cleaned by the tenants at the
end of the contract.
Illicit use   (f). Not carry on in the property any profession, trade or of property
of property   business or let apartments or receive paying guests or use the Property
    for any other purpose than that of a private residence.
     
Subletting   (g). Not part with the possession of or sub-let the property without the
    consent in writing of the Landlord (such consent not to be unreasonably
withheld).
Pets   (h). Not bring into the Property or keep on the premises any cat, dog or other
    domestic animal or bird except with the express written permission of the
    Landlord.
     
Landlord   (i). Permit the Landlord or his agent at reasonable times of the access day
access   on giving 24 hours' notice to the Tenants to enter the Property for the
    purpose of viewing its condition, effecting repairs or viewing the Property
with prospective tenants.
Forwarding   (j). Inform the Landlord immediately on receipt of any Notices statutory
Notices   notice served by any local authority regarding the Property.
     
Report of   (k). Promptly report all items of damage and structural  disrepair to the
disrepair   Landlord or his agent.
     
Preparation for viewing for new tenants

(l).

Present the property in a very  clean and tidy state when prospective tenants come to view in January/ February or until the property is rented out.
     
Preparations   (m) Yield up the property, (including all goods in the kitchen) at the end of the Tenancy  in a thoroughly clean condition and make good and pay for
before giving   the   repair of and/or replace any items damaged or lost during the Tenancy.
up possession The outside and inside of the windows are to be cleaned by tenants at the
    end of the contract.
The front and rear areas belonging to the property are to be cleared of all rubbish.
    (n). Leave the items in the Property at the end of the Tenancy in the rooms
    or places in which they were situated at the beginning of the Tenancy.
     
    (p). Return all keys that were given for the property directly to the Landlord or his agent. Failure to do this will result in a charge being made of £35.00 per replacement set of keys per individual room and £85.00 for a replacement front door lock and keys if any for it are not returned.
     
     
Forfeiture 7. Provided that if the Rent or any instalment or part thereof  of shall be in
of   arrears for at least ten days after the same shall tenancy have become
tenancy   due (whether legally demanded or not) or if there shall be a breach of any
of the agreements by the Tenants, the Landlord may re-enter on the
    property and immediately thereupon the Tenancy shall absolutely
    determine without prejudice to the other rights and remedies of the
Landlord.

THE LANDLORD'S OBLIGATIONS

     
Payment 8. The landlord agrees with the Tenants as follows-
of   (a). To pay and indemnify the Tenants against all outgoings in Rates respect
Rates   of the Property (except as otherwise provided by this Agreement).
Quiet (b). That the Tenants paying the Rent and performing the agreements on the
Enjoyment   part of the Tenants may quietly possess and enjoy the Property during
the Tenancy without any unlawful interruption from the Landlord or any
    person claiming under or in trust for the Landlord.
     
Duty to 9. The Tenancy Agreement shall take effect subject to the provisions of
Repair   Section 11 to 16 of the Landlord and Tenants Act 1985 as appropriate.

Notice of an Assured Shorthold tenancy
DWELLINGS IN ENGLAND AND WALES
 
To :
1. You are proposing to take a tenancy of
       from the 11th day of July 2010
       to the       9th  day of July 2011
2. This notice is to tell you that your tenancy is to be an Assured Shorthold tenancy. Provided you keep to the terms of the tenancy, you are entitled to remain in the dwelling for the fixed period agreed at the start of the tenancy. At the end of this period the Landlord has the right to repossession if he wishes.
3. The rent for this tenancy is the rent that is agreed between yourselves and the landlord and has not been determined by the Rent Assessment Committee. This does not affect your right as tenants or the right of the Landlord to apply to the rent assessment Committee for the registration of a market rent. If the committee feels that there are sufficient numbers of properties in the locality let on assured tenancies and the rent you have agreed is significantly higher than that which might be reasonably expected for such a tenancy the Committee will fix a new rent. A rent fixed in this manner is a legal maximum.
